1. Acceptance of Terms

By accessing or using the Dibs on Cribs platform ("Platform") operated by Dibs on Cribs LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

Dibs on Cribs is a technology platform that provides homebuyers with data-driven tools, calculators, market analysis, and AI-assisted resources to support independent home purchasing decisions. Dibs on Cribs is not a licensed real estate brokerage, real estate agent, mortgage lender, attorney, or financial advisor. Nothing on our Platform constitutes real estate advice, legal advice, financial advice, or mortgage advice.

3. Not a Brokerage

Dibs on Cribs LLC is a technology company. We do not represent buyers or sellers in real estate transactions. We do not hold a real estate broker's license. Our tools are designed to help self-directed buyers conduct their own research and make their own informed decisions. Any offer you submit, contract you sign, or transaction you enter into is your sole responsibility. We strongly recommend consulting with a licensed Florida real estate attorney before submitting any offer or signing any contract.

4. Accounts and Registration

You must create an account to access certain features of the Platform. You are responsible for maintaining the security of your account credentials. You must be at least 18 years of age to create an account. You agree to provide accurate and complete information when creating your account.

5. Subscription Plans and Payment

Free Tier

A limited free tier is available with no credit card required, subject to usage limits (currently 2 free True Cost analyses and 2 free Neighborhood analyses per account).

Scout Tier

$49 for 3 months of access, extending at $19/month thereafter. Grants access to Scout tier tools as described on our pricing page.

Full Service Tier

$1,995 for 3 months of access, extending at $495/month thereafter. Grants access to all Scout and Full Service tier tools as described on our pricing page.

Billing

Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method for the applicable subscription fee. All fees are in US dollars. Subscriptions automatically renew at the monthly extension rate unless cancelled before the renewal date.

Refunds

We offer a 7-day refund policy for new subscriptions. If you are unsatisfied within 7 days of your initial purchase, contact us at support@dibsoncribs.com for a full refund. No refunds are available after 7 days or for monthly extension charges.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE DATA OR OUTPUTS WILL BE ACCURATE, COMPLETE, OR CURRENT.

Calculator outputs, market analyses, AI-generated offer recommendations, inspection triages, and all other tool outputs are estimates only. They are provided for informational purposes and should not be relied upon as the sole basis for any real estate, financial, or legal decision. Always verify information with licensed professionals.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIBS ON CRIBS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSSES RESULTING FROM REAL ESTATE TRANSACTIONS UNDERTAKEN IN RELIANCE ON OUR TOOLS.

Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Dibs on Cribs LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

10. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to the DryGround™ property intelligence system, calculators, AI models, and brand assets — are owned by Dibs on Cribs LLC and protected by copyright, trademark, and other intellectual property laws.

11. Third-Party Services

Our Platform integrates with third-party services including Google Firebase, Stripe, SendGrid, property data Data, and Google Cloud. Your use of these services is subject to their respective terms of service and privacy policies.

12. Attorney Referral Services

The Legal Consult feature connects Full Service members with independent Florida real estate attorneys. These attorneys are independent practitioners, not employees or agents of Dibs on Cribs LLC. Dibs on Cribs LLC is not a law firm and does not provide legal services. Any attorney-client relationship is solely between you and the attorney you engage.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your access to paid features will cease at the end of your current billing period.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Hillsborough County, Florida. You consent to the personal jurisdiction of such courts.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or platform notice. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
